Terms of use
The simple rules for using AlphornStudio: what you can do and what you remain responsible for.
In short
AlphornStudio is an independent, voluntary project, free for now. The tools are an aid: check important results and keep a copy of your files. You remain responsible for what you import or publish, and you must hold the rights to it. Reported content may be hidden while it is being reviewed. Swiss law applies.
1. Purpose
These terms of use govern the use of the services belonging to the AlphornStudio ecosystem. This includes in particular AlphornScore, AlphornTrainer and AlphornTuner, as well as the future AlphornZik and AlphornSpots once they are offered.
Using a service implies acceptance of these terms to the extent applicable.
2. Nature of the project
AlphornStudio is currently an independent, voluntary project. The services are offered free of charge. No guarantee is given that they will always remain free.
3. Changes or discontinuation
AlphornStudio may in particular:
- change a feature;
- add features;
- remove features;
- temporarily suspend a service;
- permanently discontinue an app;
- end all or part of the project.
As far as reasonably possible, users will be informed when these changes have a significant consequence for them.
4. Accounts
AlphornScore and AlphornTrainer may require an account. Users are responsible for access to their email address and for the security of their means of authentication. A username may be chosen freely.
AlphornStudio may, however, intervene when a username or the use of an account constitutes in particular:
- identity theft;
- a breach of the law;
- an infringement of a third party’s rights;
- an obvious abuse of the service.
5. User content
Each user remains responsible for the content they import or publish. This concerns in particular:
- scores;
- PDFs;
- scans;
- MusicXML files;
- credits;
- other files or information added by the user.
THE USER IS SOLELY RESPONSIBLE FOR THE SCORES, PDFS, SCANS, MUSICXML FILES AND OTHER CONTENT THEY IMPORT, SHARE OR PUBLISH. THEY MUST HOLD ALL THE NECESSARY RIGHTS. ALPHORNSTUDIO CANNOT BE HELD LIABLE FOR ANY PUBLICATION OR SHARING CARRIED OUT WITHOUT AUTHORISATION, TO THE EXTENT PERMITTED BY APPLICABLE LAW.
6. Publishing a score
Any public publication requires the confirmation: “☐ I confirm that I have the necessary rights to publish this score.”
This confirmation does not transfer to AlphornStudio any responsibility for the origin of the content or the associated rights.
7. Credits
Users must fill in the appropriate credits where these are required. They are responsible for the accuracy of the information entered, in particular regarding:
- author;
- composer;
- arranger;
- lyricist;
- rights holder;
- licence.
8. Downloading
The author decides whether a public score may only be viewed, or may also be downloaded by other users.
The technical possibility of downloading confers no additional rights over the work beyond those granted by its author or its licence.
9. Reporting
Any content likely to infringe copyright, impersonate a third party, display false credits, be illegal, be clearly offensive or abusive, or infringe the rights of a third party may be reported to: contact@alphornstudio.ch
10. Removal of content
AlphornStudio may remove or hide content while it is being reviewed when a plausible infringement of rights is reported. The content may be restored if its publication appears legitimate.
11. Suspension or deletion of an account
AlphornStudio may suspend or delete an account in particular in the event of:
- serious abuse;
- repeated abuse;
- clearly unlawful publication;
- infringement of third-party rights;
- an attempt to compromise the security of the service.
Such a measure will be applied proportionately when circumstances allow.
12. Accuracy of the music tools
AlphornStudio provides tools intended to make music practice easier. They may relate in particular to:
- scores;
- notes;
- harmonics;
- rhythms;
- tempos;
- teaching exercises;
- musical analyses;
- audio playback;
- transpositions;
- musical calculations.
These features are aids and do not guarantee absolute accuracy. Users must check the results when they are important for their use.
13. Availability
AlphornStudio does not guarantee:
- permanent availability;
- the absence of interruptions;
- the absence of errors;
- compatibility with every device;
- that a feature will be kept indefinitely.
14. Backups
Even though the service allows scores and data to be stored, users are advised to keep their own copies of important files.
15. Limitation of liability
To the fullest extent permitted by Swiss law, AlphornStudio accepts no liability for damage resulting in particular from an interruption of the service, a software error, unavailability, data loss, an incorrect musical result, an incompatibility, content published by a user or inappropriate use of the services.
The services are provided “as is”, with no guarantee that they will meet all of the user’s needs or that they will be available without interruption or error.
Any exclusion or limitation of liability applies only to the extent permitted by mandatory Swiss law.
16. Free services and future paid services
The services are currently free. AlphornStudio may later offer:
- premium features;
- subscriptions;
- purchases;
- other paid services.
No payment will be due without clear prior information about the price and applicable conditions. New terms may then be introduced.
17. Termination by the user
Users can delete their account. They can export their data before deleting it. They can also delete their public content.
18. Applicable law
These terms are governed by Swiss law. Subject to mandatory places of jurisdiction provided for by law, AlphornStudio is legally attached to the canton of Vaud.
